out.
At nine o'clock on the morning of
the shooting, I hitched up my team,
myself, family and Mrs. j-__igl.s
starting to go visiting. We met
Loomis; Iw said, you are going again
are you? With that he jumped in
tlie wagon, struck me on the side of
the'head and said he could put a bullet through my hearl. Then he
struck my wife, knocking off her hat.
He then jumped out of the wagon.
Mrs. I.e:.gles was frightened and also
jumped out of the wagon, but after
walking a few rods got in again. I
heard the report of a rifle, looked
around, nnd saw Loomi*. on the hiiE
and the smoke from the gun. My
horses . farted ro run. I heard a sac-
owl shot and afterwards a third shot,
when my vlA. said she was shot. I
then drove 15 or 20 rods farther and
stopped. When I was helping my
wife out of the wagon I saw Loomis
put his gun on his shoulder and
walk toward the corner. 1 examined the wagon and found that one
shot went through the wheel and one
hit the end board of the box, glanced
and went through the front"of the
wagon. This wa. the shot that hit
my wife I think. Mr. Farreli and
Mr. and Mrs. Cross and some others
helped me stop the horses.
Cross examination: I don't remember of having mort. than three fusses
with Mr, Loomis. I don't understand that he had reason to quarrel
about the hogs. I always kept my
hogs shut up and Jim didn't. I
was going to draw in some hay aud
told him to shut his up. He answered: I am going to h— as fast as I
can and shall do all I can to destroy
your property you — _
•. I don't know .whether he
was mad about the hogs or something else.
The quarrel about two years ago
occurred over some colts. His barn
stood near the road. When he opened the door it opened through into
the field. They (the colts) got out
and his barn was open. Ji saw that
they were going into his field, so I
ran around his barn to head them off,
when I met him. He said,
, I will fix you if
you do not take care of your colts.—
After we had the second quarrel
three or four days ho crime over to
have me holn him thrash. We
neighbored after that until the last
quarrel..
