There is not a, great deal of disappointment over the matter at Kaiton
as there was not an overpoweving
desire on the part of any very large
number of peraoas that the territory
spoken of be 3et oh'. Thb Press has
one regret in the premises. The bill
for publiBhing notice as required by
law remains un]>aid and it may be
necessary to have a big law suit over
a small amount.
"I want a warrant for Bill Swan-
son" demanded an irate individual
of Justice Mclntyro Tuesday night.
"When told that he would have to
givo security for costs tho man was
somewhat wrathy, declaring that he
wauted to take Bill in behalf of the
People and he guessed he knew
what the law was as well as the next
man. He had four charges to prefer
against Swanston but the Court
wouldn't listen to him-until he had
complied with the law and the would
be complainant had to depart without his writ. It is ft mistaken idea,
which some people have that a Justice ofthe Peace is compelled to issue
a warrant whenever called upon to
do so. He has no right to taKe the
complaint even before security for
costs is filed uuless the Prosecuting
Attorney givea an order for the papers to issue.

Constable D. B. Dwyer took possession of Zemon & Sable's stock of
goods Wednesday morning by virtue

When the store was closed, Mr. 5Ie-
mon denying the authority of the
mortgagor, Mr. Jacobson, under
whose instructions'Constable Dwyer
acted. The difficulty lead to the
issuance of a warrant for the arrest of*
Jacobson charged with assault and
battery and the trial has been sot
for Tuesday. Belations betweea
Messrs. Zemon and Sable have nob
been very pleasant for some time
past and a dissolution of partnership
was talked of. In December lust,
one Jacobson of Greenville, a mem-
bar of the above mentioned firm and
who, by the way, is sn uncle of Louie Sable, induced Eemon. <& Sn-
ble to execute a morgage of $2500 to
his firm to secure a $7ft0 debt, tbo
$2500 being made payble in threo
days. Zemon now claims that ho
was argued into this piece of foolishness by Jacobson and. Sable. The
mortgage of course waa not paid and
on Wednesday Jacobson came on and
took posession, advertising the goods
•for sale, next week. Meantime Zemon had not been idle. E, D.
Wheaton his solicitor fiffed a bill in.
chancery yesterday, reciting that the
mortgage was procured by fraud and
praying for an injunction restraining
Sable from collecting any debte clue
the firm or disposing of any of the
goods and enjoying Jacobson & Net-
zoogfrom foreclosing the mortgage.
Pending the hearing of the cause a
temporary injunction was granted as
prayed for by Zemoa who also asks
for dissolution of partnership and an
accounting. Here the matter restH
for the presnt. We hope the firm
will be'able to come out of the difficulty all right and resume business
