Jim Can- was brought up from the
Midland jail Tuesday morning in the
custody of Sheriff Haley of Midland,
for trial upon the charge of murdering Frankie Osborn. an ininate of
his Meredith house of prostitution.
THIS JURY.
Anticipating the difficulty to be
encountered in selecting a jury Judge
Hart ordered 100 jurors summoned,
and these appeared when the trial
opened. The regular panel and 65
of the talesman were drawn beforo
both sides expressed themselves
satisfied with the following twelve
men in the box :

L. W. Leach of Grant.
N. D. Wntkins of Surry.
Anthony Cooper of Greenwood.
S. H. Graimvn of Surry.
D. W. Denno of Arthur.
G. H. Whitsido of Grant.

THE LAWYERS.
C. Stuart Draper of East Saginaw
and Mr. Ailcins of Flint are conduct
ing Carr's defense, assisted by Green
and Gallup who do the outside work.
C. "\V. Perry of Clare is managing the
case for the People, with Prosecuting
Attorney Burrit and J. Lee Potts as
assistants. The array of legal talent
was sufficient to insure a stubborn
contest from the beginning, and this
fact, coupled with the unusual interest which tlie case has already evoked drew a crowd of anxious listeners
to the court room to hear the trial.
Even while the striking of the jury
was in progress the room was packed
to its utmost capacity.
THE TE.STI.MOXV.
A. J. Scott, M. L>., was the first
witness sworn. He said :
I knew Carr at Meredith ; knew
where the Carr house was; was called there to visit Frankie Osborn
June .11, 1884. Visited her five
times, the last time on June 16th.
The first time I called she appeared
to have a chill and next time she
was suffering and depre&sed as
though from a severe shock. Told
her she had better tell me what had
happened. Found wounds on her
body. She died on 16th,, her death
being

inflicted by persons to me unknown.
She said that Murphy kicked her.
A GIRTHS STORY.

East Saginaw; lived last year at the
house of Jim Carr ; lived there three
weeks: have known him about five
years. I remember of Frankie's dy

until noon Thursday when Deputy
Sheriff Austin arrived fromEast Saginaw with John Dewey a witness
who, being sworn, testified as follow;--,
ANOTHER JAIL BARGAIN.
That he had formerly worked in
the woods, but for the last.'l years he
had been a fiddler in Carr's house in
Harrison. I was in the Midland jail
the panic time Carr was; Carr told
me he was going to lay the killing of
Firankie on Murphy and that they
couldnft hurt dead men
Here the Prosecution rested but
the defense demanded, through Mr.
Draper, that the People place on the
stand all the persons mentioned by
Daisy Young, as thoso being present
when Carr kicked and struck ITrank-
ie. The Court ordered the People to
produce the witnesses and subpoenas were issued for May Harvey,
Nettie Evans and Belie Baker.
Through information derived from
defendant's council the sheriff was
enabled to get May Harvey and
Nettie Evans in a lew minutes.
May Harvey sworn. I reside in
Meredith; h.-tve been there over a
year, was living there last June. I
knew ICrankie. She lived at Mr.
Oarrs', I did not know of Frankie
being injured.
Cross Examination—I have been
here over a„vear. I went to Meredith a year last April. There were
4 or f> girls at Carr's. He bought the
house last April. I was there until I
was arrested the 10th of Maryh, last.
Frankie came there the loth of May,
if X am not mistaken. She lived
there until she died. I was there all
the time she was. The night she
died I was with her. When Frankie died, myself, Miss Evans and
iBelle Baker was all the girls in the
house. There were several men
around the house when Frankie died.
She died about 2 o'clock on Monday
morning; the Undertaker came on
the noon train and went back with
the corps*.on the next train, No.

Frankie was first confined to the bed;
think it was Thursday or Friday.
Frankie and I went from Harrison to
Meredth, the 10th of May. When I
got thers Miss Harvey and Belle
Baker was there; there were no other females in the house. Did not
know that she was going to die un-
till she was dead. From the 10th
of May till Frankie died no other _
females came there. Daisy Youug "
came there on the. 3rd day of July.
She was not at that house when
Fran/fie died. Carr was not there
for several days before she died.
Mrs. Carr was up there loo/ring after matters. I came down here to
be sworn in this case for the defendant.
Question, by a Juror—Was the
girl /mown as Daisy Young.
Answer—She went by so many
names. I can't tell what her name
is.
Re-direct. I have been staying
with Mrs. Carr since Monday of
this weeA-. I was in my room when
Fran&ie died.
GATiTaUP OAJjI*S.
Mr. Gallup came to see me Monday when I first came down. Since
that time he has come ro see me
quite often; did not have much to
say to me about the trial.
J assisted in washing the body and
helping take care of her. did nob see
any blood on the floor or on the clothes. First saw the clothes in the \va3lv.
tub. Did not see tiie clothes before-
they were changed. Miss Harvey
and I together, and Bell Baker took
charge of her. I could not say
whether it was Thursday or Friday
that she was ordered to bed by the
doctor. She was not very bad on
Saturday, Sunday she was quite low.
I did tlie cooking the greater part of
the tiifie. Frankie had heen complaining about a week or ten days,
t told the grand jury that she never
told me that Murphy had hit her.
I did not tell them tnat I saw Mur-

was all in the room. The second difficulty was in the forenoon, just beforo noon. It occurred about drinks,
they were jangling: somethtng about
liquor, Carr kept brass knuskles in
the house behind the bar, had them
in his pocket this time, he took her
by the hair, raised her up and
KICKED HER
sevei-al times. May Harvey was
just coming out of her room Carr
walked behind the bar and told
Murphy to finish her. After Murphy left her Bell Baker and May
Harvev helped her up and took her
to Belf Baker's room. She died up
stairs in thc left hand room facing
the road. ,
Carr went away in the evening be- j
tween 6 and 7 o'clock.
Gaffery-took me to Meredith on
the 4th.' Carr had been ugly to men
coup'.T of times. I was afraid of him.
Carr owns the village of Harrison I
guess.
Question—Did you apply to the officers for help?
Answer—Officer, Officer. 1 supposed
they were in Carr's emplov.
Cross examination by Mr. Draper—
Frankie was not a delicate or sickly
girl; was about my size, some shorter, had been sick some time since.
Murphy had nothing to do with first
beating. It took place in the barroom. Jim Nettles was there to
dance before the beating took place.
Frankie said she was not able to
dance. We had been dancing before
10 that morning. The trouble was
that Frankie would stand and rest on
the floor. Carr was there that morning, he came back that evening with
Mr. McClennan. When he struck
her the second time he had been
there over night I think. He came
there in the forenoon, as near as I
can remember. He struck her that
forenoon and sometime that night
, >r .... ,, ,. ..she died. I saw a man they called
ing at Meredith. Frankie went! the doctor come there. I can't re-
there in April of last year, and was
there untill June when she died. I
saw Jim Carr give Frankie a couple
of beatings—the first one a week ox
so before the other. It was so severe
it laid her up. She was complaining
of being sick and they wanted her to
dance and they beat her because she
could not. The day before she died
quite a number was around. Carr
plagued her (Frankie) and she said:
"Carr, if you don't stop

on you about what I know of the
robbery." Then he struck her and
then kicked her while she was on
the floor. She got up when he got
done kicking her. Murphy was
tending bar for Carr. She was in a
bad condition then, so she could not
walk. They put her in Belle Bak-
member the time of day. Carr was
not there that night when the doctor
came. My feelings toward Carr are
not very friendly. I would not do
any thing to put him behind the bars.
Frankie said;
DON'T STRIKE ME SO HARD.
That is all I heard her say. I had
no conversation with the undertaker,
did not come down to the funeral.
Coffin came on the noon train the
morning after Frankie died ancl left
on afternoon $rain. I ran away two
days after. After Frankie died four
girls were left, 1 was first informed
of Frankie's death about 6 or 7 o'clock
in the morning.
A RECESS
At the conclusion of Daisy's testimony on "Wednesday at 3 o'clock
there was a lull in the proceedings
Of July. She was not there until
Frankie died. I was before the
Grand Jury; testified then as I do
now. Carr had not been there for
about 2 weeks before, she died. I
have been convicted as a common
prostitute in this court; expected to
have been sworn on the part of the
defense; do not remember who slept
back of my room, when Frankie
died, 1 was with her. The doctor
was alone with her while I went out
to the well after some water; was
gone about five minutes. They had
no conversation while I was in the
room. I was not with her all day
Sunday ; she was in a bad condition.
She had been sick in bed for about 3
days. She had not been complaining very much. I did not know at
any time what caused he had to beat
her. I assisted in laying her out;
did not see any black or blue spots
on her body. Mr. Carr was not
there on Sunday. I did not see any
blood in the bed. I told the Grand
Jury that she died of inflamation of
the bowels; did not tell them that
Frankie had been sick for 3 weeks
before she died. I have staid at Meredith since I had the trial before the
Justice at Mrs. Carr's. I could not
say that she is Jim Carr's wife. She
is the women that Jim Carr lived
with.' I did not testify that I was
afraid to tell all I knew, when I was
before the Grand Jury. I know a
man by the name of Henry Thompson. I saw him at the house quite
often while Frankie lived. He appeared to be quite sweet on her.
Murphy was the one that was called
Frankie's man.
I know Mr. Austin the Deputy
Sheriff; I was in his charge when arrested and had a talk with him ; did
not make a statement that I would
squeal rather than be sent up.
Nettie Evans sworn. I reside at
Meredith; have been there about 4
weeks. Came from Saginaw. Lived at Meredith before; was there in
Juno '84. knew a girl living there
at that time by the name of Frankie.
I was in the house when
VIOLENCE
was used upon her. She told me in
the morning that Murphy had licked
her the night before. She said he
slapped and kicked her. Don't
know how long after she died; think
it was 4 or 5 days. Saw black marks
on the back or her neck and shoulcl-
any other trouble that I know of.
Cross Examined—Murphy was
her man, She never reported any
other trouble. I don't recall any
marks on her limbs. Understood
tKat she died from inflamation of the
bowels. She died Monday morning;
was brought down to Harrison in the
afternoon. I don't remember when
"Did I ask you before the Grand Jury if you did nof see Murphy kick
the girl." Ans.—I don't remember,
I cannot recall the questions. I was
risked about Mr. Murphy. I did not
tell the Grand Jury thatMr. Murphy
never kicked or ill used Frankie.
I am acquainted with Dr. Scott,
never had any conversation with him
Bell Baker told me that the Dr. said
she had the ague. Did not learn that
her illness wiis serious. Miss Harvey
took care of her the night she died.
Mr. Carr was not up to see her. I
am positive that I did not see him.
He never came to the house without
I went to see him, He always came
up with a black horse and an open
buggy.
AN OUTRAGEOUS LIE.
Carr's treatment was kind to all the
girls and all his employees.
May Harvey recalled; I saw some
black marks on her neck and back
and finger nails but thought it was
mortification. I washed her body
saw no other black and blue spot,
I have been boarding with Mrs.
Carr. Don't know who furnished
me counsel in the court below. I
did not pay Gallup. Don't know
who would pay it. I never asked
any questions about it. I don't
know who furnished me counil.
Mrs. Carr said Mr. Gallup was to defend us.
Daisy Young recalled by defense.
Was brought back to Harrison in
August in complaint of Jim Carr
for larcney. I saw a Dr. at the
house of Carr's once Bell BaA-er was
sick a day and a night before,
Dr, Scott recalled by the defense. I
tified before the Grand Jury precisely
as I have testified here as near
as I can recall, I told Murphy that
t when he was drun/f he should be
careful that in stri/dng the girls
as he would injure them severely.
FranHe would probably die from
the injuries she had received.
Murphy replied, G—d d n them,
they are and it ma/tes no
difference. The doctor at this point
was as&ed to produce a booA- that
he /<-ept a minute of his daily visits
in, whieh he did showing a booA;
that loo/ced new as if it just come
out of filestore. From this he testified of some thirty two visits from
about the 1st day of May to the 10th
of June. This varied from former
testimony in the number of visits and
the date of the first visit.
Court adjourned at 5 o'cloe/.- Thursday to await another witness that
they expected from Saginaw evening train.
Friday P. M.—There is now no
prospect that the trial will be concluded this wee/r.
