Electric Railway Ordinance:
Be it ordained hy the Common Council of the Village of Saline, Michigan
as follows;
1.—ThatS. D. NeBmith,3 his heirs
or assigns are herehy granted the
right to erect poles, string wires, construct, operate and maintain an Electric Street Railroad, for the transportation of passengers,freight and express
upon the streets of the said Village and
within the bounds of said Village and"
to run cars on the same for the period
of thirty years from the passage of this
ordinance. This franchise heing granted under and subject to the following
restrictions and regulations which the
said Common Council hereby deem and
ordain to be required for the public
interest and convenience. The tracks of
said Electric Railroad to start at corporation line thence running along
Monroe street, tp Henry street, thence
through Henry street to Adrian street
thence through Adrian street and Ann
Arbor street to corporation line also
through Chicago street east of Adrian
street to Corporation limits.
2.—There shall be only a
single track and that shall be on the
middle, of each street except where the
Council shall by resolution otherwise
expressly determine, but there maybe
as many turn outs and switches as shall
be required;; provided no turn out shall
be more than 150 feet in length nor,
within 500 feet of any other turn out on
the same street, nor within 150 feet of
any corner, nor on Adrian, Ann Arbor
or Chicago street west of Harris street.
3.—Every turnout shall be equally
laid on each side of said middle line of
the street and that such track shall be
of standard guage, vis., 4 feet 8i inches
Poles to be of straight shaved cedar,
set five feet in the ground, and not less
than 125 feet apart and properly guyed;
trolley wires to be suspended not less
than 18 feet above the street, rails
shall he T, rails of not less than
45 pounds to the yard, the ties to be
of cedar" 5x5 inches by 7 feet, placed not
less than 3 foot centers, and not less
than 1760 to the mile.
4.—The space between the ties and
rails and on either side for a space of
eighteen inches shall be thoroughly
tamped and raised to the surface of the
streets on which the tracks are laid
and all cross walks shall be replaced
in as good condition as found
and shall be kept and maintained in good order and repair by
and at the expense of the said Sam'l
D. Nesmith his heirs or assigns and to
the satisfaction of thc Common Council of the Villa-go of Saline, or if not
so kept and maintained, repairs there
to may be made by or under the direction of the said Council and to thejr

shall give at least ten days notice in
Writing of their intention to make said
repairs which notice shall be served
upon said grantee his heirs or assigns
or upon any employee of them or regular employee of said road.

6".—In passing over the gutter of any-

7.—Before aforesaid grantee his heirs
or assigns shall begin the construction
cf said road there-shall befiled with the
clerk of said Village a houdin the penal
sum pf Ten Thousand Dollars with sureties which shail be approved by said
Council conditioned that said grantee
his heirs or assigns shall indemnify and

negligence pi- fault pf siny rand .all per-
construction of such road in Village of
Saline and from all loss or damage by-
reason of failure to construct sa;id - road
after the same has been begun, and
that said road will he so constructed
as herein provided within two years
from the date of filing hereinafter
mentioned acceptance.
8.—The carriages to be used on said
road shall be drawn and propelled by
electricity and no such carriage
shall be drawn or propelled thereon in
said Village at a higher rate of speed
than eight miles an hour and in operating such road it shall be the duty of
conductors and drivers to give timely
notice of the approach of such carriages
to pedestrians and the drivers of other
vehicles hy the ringing of hells.
9—The grantees of this franchise
their heirs or assigns in the operation
of this road shall employ none but care*-
ful, prudent, sober and reliable men to
take charge of the cars while on the
road and it shall be the duty of all such
employees to keep vigilant wat6h for
all trains, carriages and persons on
foot and especially children either upon
the trackes or moving'toward it and at
the first apperance of danger to such
teams, carriages, footmen, children or
other obstructions the cars shall he
stopped in the shortest time and space
possible.
10—During the construction of said
road no unnecessary hindrance or obstruction to prdinary travel shall be
permitted and ini^ae eperatiPn Of such

stand upon any street crossing or any
cross walk for any purpose whatever,
or to stand pr remain-in ene positien

minutes at any pne time, except when-

of their servants or employees.
11.—The said Common Council shall

atipn any privileges which shall impair or destroy the rights and privileges herein granted, to said grantee provided however that whenever the said

npon any street er streets upon which
the said grantee has not constructed
any line of railway they shall declare
the same hy resolution and order and
direct that said grantee shall construct
the same and it shall he the duty of the
clerk Of said Village to serve a copy of
said resolution upon the grantee or his
heirs or assigns or in his absence from
said Village upon any employee of the
said grantee or his assign if the
said grantee Or his assigns shall fail to
file witli said clerk, his acceptance in
writing withih'thirty days or fail to put
in operation sucb. line or lines of railway as he shall be so required to build
witlun one year from the time of such
notice then said Council may grant
the right of way to any other person or
company.
12.—Nothing herein contained shall

IS.—The fares for carrying ef passengers, shall be fixed by the said grantee or his assigns hut shall net exceed
the sum of live ceuts within the corporation, twenty cents tp any ppint between Saline and Clinton and twenty
cent to any peint between Saline and

14.—If at any time the said grantee

15.-—The cars used on said road shall
be of good material-and workmanship
and suitable for carrying passengers
and baggage and the conductor or
motorman iii charge of such cars shall
call the names of all the principal
streets and stations and shall exhibit
suitable red aud green lights when such
cars are being run at night.
16.—Whenever in the opinion of the
Cemmpn Council of such Village it

futher rules, orders and regulations as
may from time to time be deemed necessary te protect tbe interest, safety,
welfare or aeoemmpdatipn of the pub-
