The Village of Saline ordains:
Sec. I. All sidewalks hereafter
graded, constructed, repaired or renewed in the Village of Saline shall be
in comformity to grade lines established
by the Common Council of said. Village,
and of material and of the width and
in the manner in the following sections
described that is to say:
Sec. 2. On Chicago, Adrian and Ann
Arbor streets in front pf blocks, stores,
places of business and other buildings
built up to the street line the sidewalks
shall be twelve (12) feet in width. All
other sidewalks on Chicago stree't shall
be six (6) feet in width; on Adrian and
Ann Arb'or streets fiye (5)^ feet iri width
and on all other streets in* said village
shall he four (4) feet in width, Provided,
however, that the Common Council of
said Village may at any time by resolution order the sidewalks along any
block or street in said village; to be
wider or narrower than ahove described.
Sec, 3. Plank sidewalks shall be
constructed of good pine or hemlock
plank free from sap which shall not be
less than one and one-half (li) inches
in thickness, more than twelve (12) or
less than five (5) inches wide, and laid
cross wise upon oak, cedar, pine or
hemlock sleepers not less than three by
four (3x4) inches in size to be placed
not more than three and one-half feet
apart and not more than two inches
from the end of the plank. The planks
shall be securely nailed with not less
than twenty (20) penny nails with at
least two (2) in each end of each plank
and not less than two (2) at every other
bearing and shall conform to the established grade.
Sec. 4. Whenever the Common
Council shall by resolution qrdev any
sidewalk %o be graded or constructed,
it shall he the duty of the Street Commissioner to notify the owner, agent or
occupant of any lot in front of or adjacent to which, any such sidewalk is
required to be graded or constructed,
to grade or build the same witbjn thirty
(30) days from the date of the service of
such notice, whereupon it shall be the
duty of such owner, agent or occupant
to build, grade or construct such walk
in the time required by. such notice,
and of the material and in the manner
required by this ordinance. Alinotices
required by this section shall be copies
of the resolution of the Common Council requiring such walk to be graded or
constructed duly certified by the village clerk under the seal of the &aid
village. If such owner, agent or occupant shall neglect to grade, construct
or build any such sidewalk within the
time required in such notice, and of the
material and in the manner required in
this ordinance and shall make default
therein it'shall then be the duty of the
Street Commissioner to at once cause
a sidewalk to be gradedand constructed
and of the material and in the manner
herein required, and the expense
thereof shall be assessed upon and become a lien against the lot, land or
premises in front of or adjacent to,
which such sidewalk is required to be
graded or constructed.
Sec. 5. All sidewalks in said village
shall be kept and maintained in good
order and repair by theowner, agent or
occupant of the house, store, lot, land or
premises fronting on or adjoining the
same: and whenever any sidewalk-with-
in the limits of the said village shall

Street Commissioner to order such repair to be'made and to notify theowner,
agent or* occupant of any such house,
store, lot, land or premises adiace'nt' to

repair the same within forty-eight (48)
hours from the service of any such
notice. Whereupon it shall be the
duty ef any such owner, ^gent or occupant to repair any such sidewalk at
the place and in the manner and of the
material stated in such notice and within the time required therein, and if the
person so notified shall fail, make default in, or neglect to repair any such
sidewalk at the place, in the manner,

shall be the duty of the Street CourK
mSsioner forthwith to make or cause
the said repairs to any such sidewalk
to be made in the manner and of the
material stated in such notice, and the
cost and expense of all such repairs,
shall he assessed against and become a
lien upon any such lot, land or premises
in front of which or adjoining to which
any such sidewalk shall have been so
repaired.
Sec. 6. The Common Council shall
provide and direct that the cost and
expense Of the building, construction,
and repair of all such sidewalks so

and paid from the street fund, and all
such sums Of money when so paid shall
teand "become a charge against the
person to whom assessed and a lien on
and against the lot or parcel of.land in
front of or adjacent to which the said
sidewalk shall have been "graded, constructed or repaired, which lien shall
continue until the said mouey so paia
shall be repaid into or otherwise received by the treasurer of said village
and when so re2eived the same shall be
credited to the street fund.
Sec. 7. The Street Commissioner
shall keep and cause to be entered, in
a book to be provided for that purpose,
memoranda with dates, names aud
particulars of all such notices so served,
as aforesaid, to grade, construct, build,
repair or renew any such sidewalks,and
•jljall keep on file a duplicate of all such

and mode of serviee of the same; and
•shall also keep a just and true account
of all moneys paid, laid out and expended for the grading, construction
or repair ot any such sidewalks as well
as a particular description of the prem
ises in fron t of or adjacent to which any
such sidewalks shall have been graded,
constructed or; repaired, and on or before the first Monday of February in
each year shall report the said expenditures in writing to the Common Council, so arranged that there will appear
from such report the particular sum of
money which shall have been expended
in the grading, construction or repair
of each particular sidewalk in front of
or adjacent to each particular description of lands.
Sec. 8. Whenever any such certificate shall be received by the Common Council the said Common Council
shall at the same or next meeting
thereof refer the same to the assessor
and clerk of the said village who shall,
meet as a Board of Review at the same
time and place of the review of the
general assessment roll of said village
to pass upon and determine the accuracy of the said certificate and shall
give notice to all persons named in the
said certificate of the time when and
place .where such meeting will be held
at which meeting alter hearing the
complaints of all persons considering
themselves aggrieved by such assessment such Board of Review shall proceed to determine the truth of such
certificate and shall have power and
authority to change any sum of money
stated therein, to correct any description of land mentioned in the same and
take any other action to review and
correct said certificate in such manner
as they shall deem just which determination shall in all things be final
and conclusive. After such determination said Board of Review shall certify
its determination tothe Common Council, and the Common Council shall
cause the money so found by tho said
Board of Review to be due and owing
for- the grading, construction or repairing of any such sidewalk or sidewalks, to be assessed on and against
the owner of and against the" lands in
front of or adjacent to which any such
sidewalk or sidewalks shall have been
graded, constructed or repaired "by the
said Street Commissioner, and shall
certify such determination and order of
assessment to the assessor of said village. The said'assessor shall on receipt thereof proceed to set down in
and •■ssess upon the general assessment
roll of the said village for the then
current year the sum or sums of money
so certified against each particular lot
or parcel of land so in said order of
assessment mentioned against which
the said sums of money are respectively
charged, by adding such sums of money
to the general village tax, and said
sums of money so set down in said
assessment roll shall be and become, a
charge agaiinst the person to whom
assessed and a valid tax against the
lot or parcel of land in front of pr adjacent to which any such sidewalk may
have been graded, constructed, or repaired by the said Street Commissioner
and shall be^coUected in thesame manner in every particular as the other
village taxes set down in and spread
upon the said assessment roll are
collected.
Sec. 9. In case the tax assessed on
any such lot or parcel-of land charged
with the expense of grading, constructing or repairing any sidowalk as provided by' this ordinance shall not be
paid or collected and any such lot or
lands shall be returned foK non-payment

Sec. 10. All notices required to be
served by this ordinance shall Deserved

of the lands fronting on or adjacent to
which it is proposed to grade,construct
or repair any such sidewalk, if such
owner shall be found within thevillage.

shall not be found within the village,
then such notice shall be served by
posting the same in some conspicuous
place uppn the said lauds: provided
however that the notice of the meeting
of the Boardof Review shall'be'given

general assessment roll of said village
whieb shall be authenticated by due
proof by affidavit on Tile with the Village Clerk previous to the time of
meeting or said Board of Review.
Sec. ir.''The Street Commissioner
is hereby authorized and it shall be ty"s
duty to grade, construct a^d/vSpftnT

adjacent lands: but no such sidewalk
shall he graded, constructed or repaired when the post and expense of
the labor and xoatei-ial thereof shall be
more than flye dollars unless such improvement shall first have been ordered
by the Common Council.
Sec. 12. It shall be the duty of every
owner, agent or occupant of any lands
who shall be notified by the Common
Council or Street Commissioner to
build, construct or repair any sidewalk
or sidewalks to promptly cpmply with
such notice, and grade, construct or
repair such sidewalks as ordered, aud
in case any owner, agent or occupant
•shall neglect to so grade, build, construct or repair any such sidewalk or
sidewalks within the time prescribed
in such notice and in case the village
by any suit, action or other proceedings
shall b-5 compelled to pay damages fqc

agent ov buoupant in addition to tdi
other lines and liabilities provided by
this ordinance shall bo liable to the
village for the amount of all damages
and costs so paid, and -tho suine may be
collected in au action iu tho name of
the said vilhige in any court of competent jurisdiction.
Sec. 13. Any owner, agent or occupant of any lands or any other person
grading, constructing, reconstructing,
renewing or repairing any sidewalk,
contrary to the provisions of this ordinance, or of material other than
hereinbefore prescribed except the
same be stone or cement, shall, on conviction thereof, he punished hy a fine
not to exceed twenty-five (2S) dollars and
the costs of prosecution: and in the imposition of any such fine and costs the
court may make the further sentence
that the offender be imprisoned in the
commpn jail of the County of Washtenaw until the payment thereof, provided that the term of any such imprisonment shall not exceed a period of
thirty (30) days.
Sec. 14. In ordering the grading,
construction or repairing of any sidewalk it shall he sufficient in the resolution or oVder therefor to specify the
street and side of the street upon which
said sidewalk is or shall be located,
and the name of the owner or occupant
of the house, store or premises in front
of or adjacent to which any such sider
walk shall be ordered to be graded,
constructed or repaired.
Sec. 15. The Street Commissioner,
hy virtue of his office, shall be inspector
of sidewalks. It shall be the duty of
such inspector of sidewalks to make inquiry in relation to, and at all times to
note the condition of all the sidewalks
within the limits of the village, aud report all sidewalks in need of repair or
reconstruction to the Common Council.
Sec. 16. All sidewalks within the
limits of the village shall be graded,
constructed and repaired of cut stone
flagging-, cement or plank as provided
for herein and on the grade established
or to be established by the Common
Council and not otherwise, and shall be
graded, constructed or repaired under
the supervision of the Street Commissioner and in a manner and of materials
provided for in this ordinance if plank
and if stone or cement then of such
materials and in such manner as shall
be approved by the Street Commissioner, All sidewalks shall be graded,
laid and constructed in the street and
on a line parallel with the property
line of the adjacent property and distant therefrom as follows, to-wit: All
sidewalks of greater width than six
feet on and along such property line:
all sidewalks six feet in width one foot
therefrom: all sidewalks five feet in
width, one and one-half feet therefrom,
and all sidewalks less than five feet in
width two feet from such property line.
This ordinance shall take effect and
be in force on and after the first day of
October, A. D., 1893.
