1969-70 BUDGET:
It was moved by James Umphrey, seconded by Mrs. Kotharine Hofstad and
carried that the fo ll owing Resolution, granting the Admi nistration authority
to operate without an approved budget for the 1969-70 year be adopted:
RESOLUTION OF CENTRAL MICHIGAN UNIVERSI TY BOARD OF
TRUSTEES (BEING THE CONSTITUTIONAL AND STATUTORY BOARD
OF CONTROL OF CENTRAL MICHIGAN UNIVERSITY) AUTHORIZING
EXPENDITURES FOR PERIOD 7-1-69 THROUGH 9-30-69 PRIOR TO
APPROVAL OF 1969-70 OPERATING BUDGET.
Resolution
WHEREAS, the 1969 Legislature has as yet (6-18-69) not approved
appropriations for ·the 1969-70 Fiscal Year, and
WHEREAS, it is not possible to adopt on Operating Budget for the
1969-70 Fiscal Year until the Legislature acts on appropriations,
and
WHEREAS, it is necessary to pay 1969-70 salary costs starting 7-6-69
and operating costs starting 7-1-69, NOW

BE IT RESOLVED that the President of Central Michigan University
be authorized to expend such funds as a re necessary to pay salary,
wage a nd opera ting costs 0' are necessary to keep tne institution
operating for tne period 7-1-69 th rough 9-30-69.
MARRIED STUDENT APARTMENTS:
Presiden t Boyd announced that Wakely-Kushner Associates will be employed
as the architectural firm for the construction of the Married Student Apartments.
Cha irman Forti no stoted that na action was required on the part of
the Board in this decision.
TRAFFIC ORDINANCE AMENDME NT:
Nootian was made by lawrence Rahilly, seconded by lloyd Cofer and carried
that the Ordinance to Govern and Control Parki ng, Traffic and Pedestrians
at Centra l Michigan University, originally adopted by the Board of Trustees
in November of 1968 and made effective March 1, 1969, be amended as
fo ll ows:
Section 15.00 VEHICLE REGISTRA TION
Amend tne next to the lost sentence in Paragraph 15.02 1, under
Section 15.02, DISPLAY OF PERMIT, by substituting for the
four th word , "must", the word "should" . The sentence would
tnen read, "An expired permit should be removed before a new
one is affixed. "
HOUS ING RA TES:
It was moved by James Umphrey, seconded by lawrence Rahilly and carried
that housing rates for the ensu ing year (effective September I, 1969) be
estab lished as fo llows:

continues in full force and effect until 11:59 P.M. , June 30, 1972 is

The fo llowing Reso lution was read by Chairman Fortino before the Boord of
Trustees members :
RESOLUTION
BE IT RESOLVED THAT the Con tract doted July 16, 1968 between
Central Michigon Un iversity and the Clerical Service Staff Associati
on of Centra l Michigon University as amended by the tentative
salary and economic agreement a rrived a t on June 30, 1969 which
is to become effective on July 6, 1969 is approved provided the
contract is ratified by the employees in the clerica l service stoff
bargoin ing unit. The President and the Personnel Director of the
University are empowered to sign the Agreement on beha lf of the
Board of Trustees .
It was moved by Mrs. Jean Bockus, seconded by Lloyd Cofer and corried
that the above mentioned contract be approved. (Copy of the contract on
file in the Secretory's Office ).
James Umphrey requested that it be noted in the minutes that these contracts
arrived in the hands of the Boord the some morn ing as the meeting . Although
he places the greatest confidence in both the Universi ty and the Union, he
would hope that in the futu re involved documents such as this cou ld be read
and studied by the Boord prior to the meeting.
LABOR MEDIATION BOARD, NOTICE FROM:
In June the Univers ity received a notice from the Michigan Lobar Mediation
Boord sta ti ng tha t a petition has been filed by members of the fac ul ty
requesting a hearing to estab lish the loca l chapter of the Michigan Associa tion
of Higher Educa tion as the facu lty borgaining unit. The University has been
in touch with the lobor Mediatian Boord and a do te for heari ng has not been
estab lished .
The Trustees indicated a desire to discuss a brood range of subjects with the
fac ulty and the following motion was mode by lloyd Cofer, seconded by James
Umphrey and carried:
" The Boord of Trustees having been adv ised that a petition has been
fi led with the Michigan Labo r Mediation Board deems it desirable
to have a conversa tion with the facu lty on personne l matters of
mutual interest. To accomplish th is objective the Boord recommends
that a committee of th is body meet with representatives of the

faculty and the adm inistration . It is suggested that the Chairman
of the University Senate, President of the loca l chapter of the
A. A.U. P. and the President of the local chapter of the Michigan
Association of Higher Education be asked to confer to determine
the method for selec ting the faculty members. "
DEVELOPMENT FUND BOARD CONSTITUTION REVISION;
The Boord of Trustees was advised that Act 3 15 of the Public Acfs of 1968
amended the State Income Tax Act by add ing Section 20. This section provides
a credit aga inst the income tax for charitable contributions to instituti
ons of higher learning . The credit is allowed only if the gift is made to the
general fund of the institution. The Michigan Deportment of the Treasury,
Revenue Division, has ruled that the contribution to the general fund provision
requ ires that the gift be under the control of the governing body of
the institution and that it be mode for the same purposes that are reflected
in the Legislative appropriations for the institution.
In reviewing the Central Mi ch igan Un iversity Deve lopment Fund Al umni
Trust Agreement (Constitution), there are several provisions which may be
in conflict wi th Act 315 and if the specified inte ntion of the Development
fund Constitution is ca rried to its logical conclusion, the con trol of funds
is with the Development Fund Boord and not the Un iversity .
The Development Fund Board a t their June 20, 1969 meeting passed a resolution
that the Constitution be amended to clearly specify that the Deve lopmen t Fund
Boord is subject to the control of the University Board of Trustees and that a ll
funds ore token in the name of the University. A suggested Constitutional
revision was submitted to the Board of TrlJStees and approved . (Copy on fi le
in the Secretory to the Boord's file}. It was suggested that the adm inistration
and the Deve lopment Fund Boord Directors develop a fi nal draft for adoption.
LAKE SUPERIOR COllEGE, LETTER OF COMMENDATION TO;
The Boord was in unanimous agreement with Roger Busfield's recommendation
that the Secretary of the Boa rd send a letter of commendation to lake
Superior College on becoming an a utonomous state co llege in Michigan.
Acting Dean Edward Whitmore was introduced and mode a presentation on
the School of Arts and Sciences .
The next meeting of the Boo rd will be August 23-24, 1969 at Beaver Island.
Meeting was adjourned at 4:00 P.M.
